IMIMIGRANT VISA : GREEN CARD

An immigrant visa, commonly called the green card, gives the right to apply for entry into the United States to reside and work permanently with no restrictions. The green card can be obtained through:

- the lottery
- the sponsorship of a U.S. citizen or permanent resident
- U.S. employer
- U.S. religious organization
- oneself

 

 

 


Lottery

The lottery program was created in 1990 to increase the level of immigration from countries whose nationals are the least represented in the pool of immigrants. Accordingly, approximately 55,000 visas are allocated annually among foreign countries with some country's nationals being ineligible to participate, such as Mexico and China.
Procedure and conditions

Sponsorship by U.S. family member

A U.S. citizen can sponsor his/her spouse, children or parents for a green card. The sponsor must submit an affidavit in which he/she promises to support the applicant and/or pay for any public benefit the applicant might receive after entry in the U.S. No affidavit is required for a child under 21 years old.

Sponsoring a Spouse

A U.S. citizen can sponsor his/her foreign spouse for permanent residency. The green card will be conditional if the marriage is less than two years old.
A widow of a U.S. citizen can self petition if married for at least two years and filing the petition within two years of spouse's death.
A battered spouse of a U.S. citizen can also self petition.

Main conditions:
- Evidence of bona fide marital relationship
- Evidence of legal validity of the marriage certificate, need to show legal termination of any prior marriages.
- If conditional residence is granted, must show within 90 days of the end of the second year of conditional residence that marital relationship still exists or show that (1) marriage is terminated because of death of the spouse, (2) although divorced, the marriage was entered into in good faith, or (3) foreign spouse was "battered or subject to extreme cruelty" by U.S. spouse during marital life.

Sponsoring a Parent

A. U.S. citizen can sponsor his/her parent for permanent residency if he/she is at least 21 years old. There is no quota for this category.

Sponsoring a Child

A U.S. citizen can sponsor his/her child for permanent residency. A battered child of a U.S. citizen can self petition.
If child is over 21 or married, then petition is subject to annual quota and must wait until a visa number becomes available.

For stepchildren and adopted children, the relationship must have existed before child reached the age of 18 or 16, respectively.

Sponsoring a sibling

A U.S. citizen can sponsor his/her brothers and sisters subject to an annual quota. If quota is exhausted, the approved petition will be held in abeyance until a visa number becomes available.

Sponsored by a permanent resident

A permanent resident can sponsor only his/her spouse and unmarried children who are under 21 years old and subject to an annual quota. If quota is exhausted, the approved petition will be held in abeyance until a visa becomes available.

Sponsored by a U.S. employer

A U.S. employer can sponsor for permanent residency :
- a person of extraordinary ability
- an outstanding professor and researcher
- a multinational executive and manager
- a member of a profession holding an advanced degree or a person of exceptional ability
- a skilled worker
- an unskilled worker
- a religious worker

 

Person of Extraordinary Ability

Individual with extraordinary ability in sciences, arts, education, business or athletics can self petition. Subject to an annual quota; however, the quota is rarely exhausted.

Main Conditions:
- Extraordinary ability: an individual who has achieved national or international acclaim in his/her field and whose achievements have been recognized through extensive documentation. International award might be sufficient. If not, must meet at least three of the following: received a national award, is a member of an association that requires outstanding achievement, has major publications, has judged the works of his/her peers, made original contributions to his/her field, authored scholarly work, produced artistic exhibitions, had a leading role in organizations with a distinguished reputation, has commanded a high salary compared to his/her peers, has had commercial success in the performing arts
- Must intend to continue working in the same field once in the United States
- Entry in the United States will substantially benefit the United States

Outstanding Professor and Researcher

This category is subject to an annual quota. However, the quota is rarely exhausted.

Main Conditions:
-
Must be recognized internationally as outstanding; must have two of the following: received major awards, a member of an association that requires outstanding achievement, referred to in publications of his peers, has judged the work of his/her peers, has produced original scientific research, has authored scholarly work
- Must be offered a tenure teaching or research position

Multinational Executive and Manager

This category is subject to an annual quota. However, the quota is rarely exhausted.

Main Conditions:
-
U.S. employer must be affiliated with a foreign corporation
- Previously employed in a managerial or executive position, at least one year within the last three years
- Position offered must be managerial or executive

Member of Profession Holding an Advanced Degree/Person of Exceptional Ability

This category is subject to an annual quota. However the quota is rarely exhausted. Check waiting list

Main Conditions:
-
Must be a member of a "profession" holding an "advanced degree" or because of exceptional ability in the sciences, art or business he/she will substantially benefit the national economic, cultural or educational interests of the U.S.
- Must be sponsored by U.S. employer
- Employer must obtain Labor Certification demonstrating that no U.S. workers are available unless can demonstrate that it is "in the national interest" to let him/her in the United States.
- Exceptional ability can be demonstrated if three of the following are met: relevant degrees are of exceptional quality, ten years of experience, license to practice profession, commanded a high salary, member in professional association, achievements recognized by peers

Skilled Worker

The category is subject to an annual quota that is usually insufficient for the demand. If quota is exhausted, approved petition is given a priority date (the date of filing) and held in abeyance until prior petitioners receive a visa. Check waiting list

Main Conditions:
-
Must be sponsored by employer
- Offered position must be of a type that generally requires at a minimum two years of experience or a bachelor degree
- Employer must obtain Labor Certification demonstrating that no U.S. workers are available

Unskilled Worker

Same as Skilled worker, but no specific requirements regarding the position offered. Because of excessive demand, the annual quota is heavily oversubscribed. Consequently, the waiting time for a visa number becomes available is generally over several years.

Religious Workers

Main Conditions:
-
Must be sponsored by religious organization
- U.S. religious organization must have affiliate abroad of which applicant was a member for the last two years
- Must be hired as minister or a "professional" with two years experience in a religious organization of the same domination
