Foreign residents or
spouses of foreign residents will likely be exposed to various legal systems
during their marital life. This exposure to various legal systems without a
prenuptial agreement adds substantial uncertainty to the separate or marital
character of their properties and to what law should apply at the time of a
divorce or death of one of the spouses. A prenuptial agreement
is an appropriate tool to address the foregoing problems, in addition to
dealing with the more common issues that may arise upon divorce or death,
such as child custody and support, alimony, division of properties and the
